1. Acceptance of Terms
By accessing and using the services provided by Arck Interactive Inc. (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“TOS”). If you do not agree to these terms, you must not use our services.
2. Services Provided
Arck Interactive Inc. provides web development, software solutions, managed hosting, and consulting services (collectively, the “Services”). These services are subject to the terms and conditions outlined in this agreement.
3. User Responsibilities
By using our Services, you agree to:
- Provide accurate and up-to-date information.
- Use the Services only for lawful purposes.
- Not engage in unauthorized access, data scraping, or security breaches.
4. Payment and Fees
- Certain Services require payment. You agree to pay all fees associated with your use of our Services in accordance with the applicable pricing structure.
- Payments are due within NET-30 days of invoicing.
- Late payments may result in service suspension or termination.
5. Intellectual Property
All materials created by Arck Interactive Inc., including but not limited to software, code, graphics, and content, remain the exclusive property of the Company unless explicitly agreed otherwise. Clients may receive a non-exclusive, perpetual, worldwide, non-transferrable license to use the work product as outlined in specific agreements.
6. Privacy Policy
Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
7. Service Availability & Support
- We strive to maintain a 99.9% uptime for hosted services but do not guarantee uninterrupted service.
- Scheduled maintenance or unexpected downtime may occur, and we will provide reasonable notice where possible.
- Support is available via info@arckinteractive.com during regular business hours: 9AM – 6PM Pacific Time.
8. Termination
Either party may terminate this agreement within 60 days written notice. We reserve the right to terminate accounts immediately for violations of these terms.
9. Limitation of Liability
To the maximum extent permitted by law, Arck Interactive Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services.
10. Dispute Resolution
In the event of a dispute, parties agree to resolve the matter through binding litigation in Portland, Oregon before pursuing legal action.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Continued use of our Services after changes are made constitutes acceptance of the revised terms.
